Nomilist
Terms of Service
Last updated 2026-11-04
These Terms of Service (the "Terms") set out the conditions for using "Nomilist" (the "Service") provided by Kenya Masuko ("we", "us"). Anyone who uses the Service agrees to these Terms.
1. Definitions
- "User" means a company or individual that agrees to these Terms and registers a bar or restaurant with the Service.
- "Guest" means a person who views the Service's pages at a User's venue, for example by scanning a QR code.
- "User Content" means the venue name, drinks, dishes, prices, photos and other information a User registers with the Service.
2. The Service
The Service lets Users list their drinks and show them to Guests in the Guest's language, with tasting notes and food pairings. We may change, add to or discontinue the Service.
3. Accounts
- Users must register with accurate information and keep it up to date.
- Users are responsible for keeping their login details secure. Actions taken with a User's login are treated as that User's actions.
- Each venue may register one account.
4. Plans and fees
- Free plan: one display language, up to 10 drinks and 3 dishes. Guest pages show a "Made with Nomilist" notice.
- Paid plan: all languages, no limit on drinks or dishes, and no "Made with Nomilist" notice. The monthly fee is JPY 3,980 (tax included).
- We may offer the paid plan at an introductory price of JPY 1,980 per month (tax included) for a limited period. Users who sign up during that period keep the introductory price for as long as they stay on the paid plan.
- We will give at least 30 days' notice of any price change, in the Service or by email to the registered address. Users on the introductory price are not affected by price changes.
5. Payment and cancellation
- Paid-plan fees are charged automatically each month to your credit card. Payments are processed by Stripe, and we do not store card numbers. Receipts are available from the billing management page.
- Users can cancel the paid plan at any time from the dashboard. Paid features remain available until the end of the billing period, after which the account moves to the free plan. User Content is kept, but items beyond the free-plan limits can no longer be added.
- Except where required by law, we do not refund fees we have received.
- If a payment cannot be completed, we may suspend paid-plan features.
6. User Content and licence
- Users keep all rights to their User Content. Users grant us permission to display, copy and translate User Content as needed to provide and improve the Service.
- Users warrant that their User Content does not break any law or infringe anyone's rights, and that it is not misleading.
- Users are responsible for what Guests see, including prices and availability.
- For User Content made public to Guests (venue name, location, drinks, dishes, prices, house rules and payment information), Users permit us to publish and distribute it through the Service's public pages, search engines, and third-party services and AI tools, including via API. Users can hide any item from the dashboard.
- Where we offer a feature that lets Guests add information to a venue's page, that information is treated as part of the User's page, and the User can edit or hide it at any time. Anyone who adds information grants us and the User a free licence to use it within the Service.
7. AI-generated tasting notes and illustrations
- The Service uses AI to create tasting notes, translations, and illustrations of bottles and dishes. Generated content is for reference only, and we do not guarantee its accuracy or completeness. Users must review it before publishing.
- AI-generated bottle illustrations may differ from the actual bottle or label.
8. Prohibited conduct
When using the Service, Users must not:
- break the law or act against public order and morals;
- infringe the rights of others;
- interfere with the Service, access it without authorisation, or place excessive load on it;
- copy or redistribute information obtained through the Service for purposes other than using the Service;
- breach laws on the sale or serving of alcohol (such as age checks).
9. Suspension of use
If a User breaches these Terms, we may suspend that User's use of the Service or delete the account without prior notice.
10. Changes and interruptions
We may suspend or change all or part of the Service without prior notice for maintenance, outages, legal requirements or other reasons. We are not liable for any loss this causes to Users.
11. Limitation of liability
- We do not guarantee that the Service fits a User's particular purpose or that it will increase sales or orders.
- Where we are liable to a User for damages, our liability is limited to the total fees the User paid us in the previous 12 months, except in cases of our wilful misconduct or gross negligence.
12. Exclusion of anti-social forces
- Users represent and warrant that neither they nor their officers are, or will become, members of organised crime groups or other anti-social forces.
- If a User breaches the previous paragraph, we may terminate the User's agreement immediately without notice.
13. No assignment
Users may not transfer or pledge their rights or obligations under these Terms to any third party without our prior written consent.
14. Notices
We send notices to Users by posting them in the Service or by email to the registered address. An email notice is treated as received when it would normally arrive.
15. Changes to these Terms
We may update these Terms. Updated Terms take effect when posted in the Service. We will notify Users of material changes in advance, in the Service or by email to the registered address.
16. Severability
If any provision of these Terms is held invalid under applicable law, the remaining provisions stay in full effect.
17. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Maebashi District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the Service.
